ANALISIS YURIDIS PENERAPAN UNDANG-UNDANG PENGHAPUSAN KEKERASAN DALAM RUMAH TANGGA (STUDI PUTUSAN NO.2055/PID.B/2024/PN MDN)
Abstract
Domestic violence can also involve wives as perpetrators, a scenario that has historically received insufficient social attention. This study aims to examine the forms of violence committed by wives and the associated criminal liability from the perspective of legal policy. A normative legal research method was employed. The findings indicate that Law Number 23 of 2004 is fundamentally gender-neutral; however, its implementation tends to prioritize the protection of women, leaving the position of male victims not fully accommodated. Wives acting as perpetrators remain subject to criminal liability if the elements of the offense are met. Consequently, concrete measures are required, including enhancing the professionalism of law enforcement officials to ensure objective case handling free from gender bias, developing more inclusive case-handling guidelines, strengthening access to reporting and protection for victims without discrimination, and increasing public awareness that domestic violence can affect anyone; such steps are essential to ensure that law enforcement is fair, effective, and victim-protection oriented.
